SUNBAKE SLICE OF THE PRIZE 2021 (THE “COMPETITION”)

The promoter is FOODCORP (Pty) Ltd and TLC Marketing Worldwide (Pty) Ltd (“TLC”) Ltd is contracted to promote this Competition (collectively “the Promoter”).

Any persons entering or participating in this Competition (“Participant”) accept and agree that by entering this Competition they have had an opportunity to read and consider these Terms and Conditions and that they are bound by these Terms and Conditions.

What is the Prize

    Qualifying Participants will receive one of the following rewards:

  1. The Prizes are not transferrable and may not be exchanged for cash or any other items. The Promoter reserves the right to substitute the prizes with any other prize of comparable commercial value.

  2. Who can Participate

  3. This Competition is open to all residents of South Africa.

  4. No director, employee, agent or consultant of:
    • the Promoter;
    • any other subsidiary or associated person who controls or is controlled by the Promoter;
    • the supplier of goods or services in connection with the Competition; or
    • the marketer of the Competition, or their spouses, life partners, business partners or immediate family members, may enter this Competition.

  5. How to Participate

  6. To enter this Competition, Participants must buy any Sunbake bread promotional pack, find their unique code inside the bag, dial *120*22265# and follow the instructions to enter. Upon entering, Participants will be asked to enter their unique codes. Three unique codes must be entered and once validated, the customer will receive a reward via an algorithm. A voucher code and instructions on how to redeem the reward will be sent to the customer via SMS. USSD calls are charged at 20c for every 20 seconds on the USSD line. Free minutes do not apply.

  7. Participants may enter as many times as they wish within the competition dates, using three different unique codes for every entry. Each unique code can only be used once. Entries which are unclear, illegible or contain errors will be declared invalid. A participant’s entries may be restricted if it is believed their entries are excessive and any future entries and the entrants profile may be blocked until investigated.

  8. The Promoter shall not be responsible for any lost, damaged or delayed entries for any reason whatsoever, and proof of sending will not be accepted as proof of receipt by the Promoter. The Promoter is not liable for any technical failures affecting the participation and/or Prize redemption process of the Competition.

  9. In the event that entry into this Competition is contingent on the Participant entering any website or social media page or application, the Participant hereby acknowledges that any and all costs associated with the required internet connection will not constitute a cost of entering into this Competition and shall be borne solely by the Participant.

  10. Personal Information

  11. By entering this Competition the Participant consents to the collection, use, storage, disclosure, processing and further processing of his/her personal information (the Participant’s name, ID number, cellphone number, address, personal preferences and other personal information the Participant provides when entering and participating in this Competition) by the Promoter and Conceptual Studio (PTY) Ltd.

  12. The purposes for processing personal information is to: (i) conduct this Competition; (ii) facilitate the Participant’s participation in the Competition; (iii) communicate with the Participant and send direct marketing communication on Sunbake and similar products via SMS for market and product research.

  13. Should the Participant object to the processing of his/her personal information and/or receipt of direct marketing, the Participant should send an email to sunbake@tlcrewards.com.

  14. By posting any content, images, or comments on any of the Promoter’s public and/or social media platforms, a Participant consents to and gives the Promoter a world-wide royalty free licence to reproduce, modify, adapt and publish such content, images or comments for the purposes of promoting the Promoter’s products and/or services.

  15. Indemnity

  16. By entering the Competition, the Participant unconditionally and irrevocably indemnifies and holds harmless the Promoter, as well as its holding company, its subsidiaries and any subsidiaries of its holding company, and their successors and assigns, directors, employees, agents or consultants against all and any losses, claims, proceeding, actions, damages, (direct, consequential or otherwise) liability, demands, expenses, legal costs (on an attorney and own client basis) howsoever arising out of, based upon, or in connection with (directly or indirectly) the Participant’s participation in the Competition and the Prize/s.

  17. Duration

  18. This Competition runs from 5 April 2021 and closes at midnight on 4 July 2021 (“closing date”). Any entries received after the closing date will not be considered.

  19. The Promoter reserves the right to reasonably extend, shorten, suspend the time period of the Competition or terminate the Competition for technical, commercial, and/or operational reasons, or for reasons beyond its control. The Competition, Prize and Terms and Conditions may be reasonably amended by the Promoter, at any time during the Competition. In such event, all Participants waive any rights that they may have/purport to have in terms of this Competition, and acknowledge that they shall have no recourse against the Promoter whatsoever.

  20. Results

  21. The consumer will qualify for a reward after purchasing 3 loaves of Sunbake Bread at participating retailers. Consumer will qualify for a reward by dialing the redemption USSD string *120*22265# & capturing their unique code to the redemption platform. Three unique codes must be entered and once validated, the customer will receive a guaranteed reward via an algorithm. A voucher code and instructions on how to redeem the reward will be sent to the customer via SMS. The reward is automatically generated by a system and the participant will not be able to choose a reward. Each participant will be entitled to 1 of the rewards per entry. A successful entry constitutes three valid unique codes.

  22. Rewards & vouchers are valid for a period of 3 months from the date of issue.

  23. The judges’ decision will be final and binding and no correspondence will be entered into.

  24. The Promoter may require the winner/s to:
    • to provide their name, identity number to enable the Promoter to verify the entry;
    • to sign an acknowledgement of receipt of the Prize, and indemnity;
    • where the entry includes the submission of any work eligible for copyright in terms of the Copyright Act No. 98 of 1978, conclude an agreement of assignment whereby any rights which the winner may have in respect of such works are transferred to the Promoter.
    Should the winner/s refuse to comply with this rule for any reason then the winner shall be deemed to have rejected the Prize, and it shall revert back to the Promoter.

  25. Any winner may be requested to take part in the Promoter’s publicity campaigns or to allow their names and likenesses to be used by the Promoter for promotional purposes. The winner is, however, entitled to decline such request.

  26. Where a winner consents to take part in the Promoter’s publicity campaigns, they will not be entitled to any remuneration for such participation and all materials arising from such participation will be the sole property of the Promoter.

In the event of a dispute, the decision of the organisers will be final and binding and no correspondence will be entered into in this regard and for further clarity, the organisers shall be entitled to deal with such disputes (or any failure by entrants to follow the rules) in their sole discretion, including that the organisers shall be entitled, in addition to any other rights which the organisers may have in terms of these rules, to immediately disqualify entrants from this promotion. By entering the promotion and/or accepting any prize, the entrants, users and/or winners hereby indemnify, release and hold harmless the organisers (including their subsidiaries, holding companies and affiliates), their directors, employees, agents, suppliers and contractors (the “organiser parties”) from and against any actions, claims and/or liability for injury, loss, damage, expense, claim or damages of any kind resulting in whole or in part, directly or indirectly, from participation in the promotion, and/or the use, acceptance or possession of a prize, and/or participation (or non-participation) in a prize-related activity.

  30. Entrants who, in the Organizers’ sole determination, act unlawfully, fraudulently, in breach of these Rules and/or Terms and Conditions or otherwise dishonestly may be disqualified from participating in the Promotion and shall not be eligible to win any prize.

  31. Foodcorp (Pty) Ltd and TLC Marketing Worldwide are not responsible for any reward misrepresentation (written or verbal) on warranties by anyone / group other than TLC Marketing Worldwide.

  32. The promoters are not liable for any technical failure that may result in an entry not being successfully submitted. Any prize is accepted by a winner at his/her own risk and the organisers are not liable, at any time, for any defect in the prize.

  33. A copy of the promotion rules is available at no cost to the customer and can be downloaded in printable form on the redemption reward site.

  34. Exclusions and other important terms

  35. Nothing in these Terms and Conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the participant or the Promoter in terms of the Consumer Protection Act, 68 of 2008 (“CPA”).

  36. By entering the Programme in accordance with its terms, Participants acknowledge that the Programme will be managed in accordance with the provisions of the CPA. Qualifying participants undertake to expeditiously do all things necessary to enable the Promoters to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required in order to facilitate handing over the reward.

  37. These Terms and Conditions shall be governed by the laws of the Republic of South Africa.

Intercity Standard Terms and Conditions for Passengers

  • Tickets are not transferable and are valid for use only by the persons to whom they are issued and for the date and time shown thereon.
  • It is the passengers’ responsibility to ensure that the correct information is shown on the ticket.
  • Any alteration to a ticket will render it invalid. Any change of trip requires the issue of a replacement ticket.
  • Positive identification may be requested when boarding the coach.
  • All fares are subject to change without notice. Intercity Xpress will only be bound by the fare charged upon the purchase ticket.
  • Intercity Xpress reserves the right of admission to any of its coaches. Upon the exercising of such discretion with reference to a bona fide ticket holder by Intercity Xpress as and when it may deem necessary, such a ticket holder would be reimbursed in full. Passengers are required to be at the departure points 30 minutes before the departure time shown on the ticket. Any seat not filled within 10 minutes prior to the scheduled departure time, will be offered for sale to standby passengers on a first come first served basis.
  • Tickets that are cancelled shall be refunded into a banking account within 15 working days, but provided that the same is done at least 6 hours before departure. Tickets that are cancelled and need to be refunded are subject to a 20% cancellation fee.
  • Cancellations done after the departure time will be refunded provided cancellation is due to death or hospitalization of the person in whose name the ticket has been issued and is subject to a 20% cancellation fee.
  • An alternative booking (the rebooking) may be done for the next available seat on the same route as the initial ticket for tickets that want to be cancelled after this period if it is 3 hours prior to departure and is subject to a 20% rebooking fee.
  • No more than one rebooking will be allowed per ticket issued. Any increase in the cost/price of the ticket will be for the account of the passenger, payable immediately on making the rebooking.
  • All rebooked tickets cannot be refunded.
  • If a passenger misses the bus, no rebooking or refund will be granted.
